Juvenile Cases

Initial / Subsequent Detention Hearings

We can represent your child at a detention hearing and this is where the judge decides whether or not your child is free to return home or not. If your child has been delivered to the detention facility, then you need to do everything you can to request a hearing for this. You will want to push to do this without a jury. We can handle this for you and we can request a hearing within 24 hours after your juvenile has been detained. If the juvenile has been detained on a Friday or a Saturday however then the soonest that the hearing can take place would be the Monday. That being said, we can take care of that for you with ease and efficiency.

It is possible that your juvenile will be taken into custody by a law enforcement officer. This is especially the case if there is a strong believe that the juvenile has been engaged in any conduct that has violated penal law and any delinquent conduct that requires supervision. Your juvenile may also be taken into custody without a warrant, as long as the officer has probable cause to believe that they have violated the laws of the state.

Adjudication Hearings

After the government have filed an adjudication hearing, the juvenile court will then need to set a time for the hearing. It is their job to prove that the allegation is in fact true, and we will work with the juvenile to personally ensure that the allegations do not move past reasonable doubt. Essentially, the juvenile is innocent until proven guilty but if your child has been proven as being guilty then the case will then move onto the disposition hearing. Although this can be a stressful time for both you and the child, we will always be here to help and support you with any questions that you may have along the way while also relentlessly representing you.

Disposition Hearings

This is very similar to the sentencing stage that you go through when you have an adult trial. You and your child will need to go through a social study and this comes right after the adjudication phase. The report from this study will be used in the disposition phase of the proceeding and after the court reviews your study it then could lead on to order probation supervision. This could include placement out of the home or your child may need to attend the Youth Commission. When the decision has been made, the court will take into account various factors such as their history of violations, the resources that are available at home and even if they have any special needs. This process can be very complicated and it can also take a long time, but our team will help you to work through it all so you can ensure the best result while also feeling confident that you are in very capable hands.

Historical Violations

There are plenty of resources available for your child at home and this includes adjustments with schools or even any identified special needs. We will push to make sure that these needs are met and we also have a vast level of experience when it comes to alcohol possessions, allegations of sexual assaults and more. The main thing to note is that the juvenile system is very different to the adult system, and if you don’t choose the right attorney then you will only be hindering your own case.

If you choose an attorney who is not specialized when it comes to juvenile cases then your child will suffer as a result. A lot of people think that their records are subjected to disclosure and that they can’t be used against them in later life.
