This offense is classified in Texas as a class B misdemeanor and has a range of punishment of not less than 72 hours confinement in a county jail, and no more than 180 days, and/or a fine not to exceed $2,000. However, Chapter 49.04(d) of the Texas Penal Code stipulates, provides for an enhances punishment range of a Class A misdemeanor (instead of a Class B misdemeanor) if “it is shown on the trial of an offense under this section that an analysis of a specimen of the persons blood, breath, or urine showed an alcohol concentration level of 0.15 or more at the time the analysis was performed”. The punishment range for a Class A misdemeanor offense under this section can range of up to one-year confinement in a county jail, and a fine not to exceed $4,000, or possibly a combination of both fine and confinement.

An individual found guilty and convicted of a DWI, where the BAC is alleged to have been greater than .15 at the time of the operation of the motor vehicle, it has very real and serious consequences that can result in possible jail time, steep fines, probation, community service, the loss of a driver’s license, and/or expensive DWP surcharge license fees.
