DWI – 1st offense (.15 or higher)

Texas enacted a law allowing for law enhanced penalties for those arrested for a DWI, and who allegedly had “BAC” (blood-alcohol concentration) of .15 or greater. According to Chapter 49.04 of the Texas Penal Code, a person commits the offense of DWI if they operate a motor vehicle in a public place while intoxicated. This offense is classified in Texas as a class B misdemeanor and has a range of punishment of not less than 72 hours confinement in a county jail, and no more than 180 days, and/or a fine not to exceed $2,000. However, Chapter 49.04(d) of the Texas Penal Code stipulates, provides for an enhances punishment range of a Class A misdemeanor (instead of a Class B misdemeanor) if “it is shown on the trial of an offense under this section that an analysis of a specimen of the persons blood, breath, or urine showed an alcohol concentration level of 0.15 or more at the time the analysis was performed”. The punishment range for a Class A misdemeanor offense under this section can range of up to one-year confinement in a county jail, and a fine not to exceed $4,000, or possibly a combination of both fine and confinement.
